Syllabus

<p>Contract — Sale—Payment of purchase money.</p> <p>Although an agreement for the sale of goods provides that a designated portion of the purchase money shall be paid at the time of the execution of the agreement, yet if the vendor accepts from the vendee a promissory note for the amount, giving a receipt therefor which stipulates that when the note is paid it will be a payment of the hand money, and at the maturity of the note extends the time of payment, he cannot, subsequently, by refusing to accept payment, break the contract and refuse to deliver the goods to the vendee, without subjecting himself to liability for damages.</p>
