CIV.R. 56 — SUMMARY JUDGMENT — VICARIOUS LIABILITY — PREMISES LIABILITY: The trial court erred in granting summary judgment in favor of defendant bar establishment on plaintiff patron's claim for vicarious liability where the defendant bar establishment presented conflicting evidence as to whether the individuals who were alleged to have assaulted plaintiff patron were acting as bouncers for the bar establishment on the night in question and therefore failed to meet its initial burden on summary judgment to show that no genuine issue of material fact remained for trial. The trial court did not err in granting summary judgment in favor of defendant business on plaintiff patron's claim for premises liability where the plaintiff patron failed to meet his reciprocal burden on summary judgment to show that any genuine issue of material fact remained as to whether the bar establishment acted reasonably under the circumstances.
