Syllabus
<p>1. Depositories — Fiscal Agent — Selection.</p> <p>The board of, liquidation of the city debt has the right to select its own fiscal agent or depository, and Act No. 110, p. 144 of 1890, does not impose on the board the specific duty to select an interest-paying bank as its fiscal agent, but the board may do so in its discretion.</p> <p>[Ed. Note1. — Por cases in point, see Gent. Dig. vol. 10, Depositaries, § 20.]</p> <p>2. Same.</p> <p>Act No. 128, p. 214, of 1906, is a penal statute which can have' no retrospective operation, and therefore cannot aiEect the selection of a fiscal agent made prior to its passage.</p> <p>3. Appeal — Review—Questions.</p> <p>Courts are organized to adjudge concrete cases, and not to express opinions on questions of general duty.</p> <p>(Syllabus by the Court.)</p>
