Syllabus

<p>1. City oe Florence — Municipal Charter — Liquors — Police Power. — The city council of Florence, under the city charter (21 Stat., 908,) conferring on it powers to pass ordinances respecting “the roads, streets, market, and police force of said city,” cannot pass and enforce an ordinance prohibiting the sale of liquors anywhere in the city. Divided Court.</p> <p>2. Municipal Corporation — Liquors—Dispensary Law. — The dispensary law does not preclude a municipal corporation from passing and enforcing an ordinance prohibiting the sale of liquors, except by duly authorized officers, where the charter gives the municipality such power.</p> <p>3. Rehearing, for purpose of submitting the case to Court en banc, refused, because no constitutional question is involved, and no two Justices of this Court request it.</p>
