Syllabus
<p>A street laid out by the commissioners, under § 7, act of February 14,1866, P. L. 81, incorporating the city of Chester, their report being duly approved, is, although unopened, an established road or way, within the meaning of § 12, act of February 19,1849, P. L. 84, requiring railroads to be so constructed across the same, as not to impede the passage or transportation of persons or property.</p>
