Syllabus

<p>Proof of falling of a trolley pole — TJpon person standing at car stopping place — Question of negligence by traction company —Law of evidence.</p> <p>Proof of the falling of a trolley pole from an electric car, when it stopped at a usual stopping place, upon a person standing there for the purpose of getting upon the car, raises the presumption of negligence on the part of the traction company, and unless rebutted the party injured is entitled to recover.</p>
