Syllabus
<p>Railroads — Crossing Other Roads — Future Contingencies — Expense — Determination. Where, in proceedings by a railroad company to condemn the right to cross street railway tracks, the court determined that there was no present necessity for safety devices, it is improvident and error to order that the petitioner, or junior road, should pay the cost of safety appliances that might be required in the future by the city or any lawful authority.</p>
