<p>APPEAL—REVIEW OP DEMURRERS—RECORD-MORTGAGES—MERGER.</p> <p>Rulings upon demurrers may be reviewed upon tbe transcript on appeal, without incorporating in tbe record any statement oí facts or tbe findings and conclusions of tbe lower court.</p> <p>Where tbe whole title, legal and equitable, unites in tbe same person, and there are no outstanding intervening interests or liens, tbe acceptance of a deed by tbe mortgagee, in which be assumes tbe mortgage debt, effects a merger of tbe two titles, which could not be defeated by tbe grantee’s thereafter assigning tbe notes secured before their maturity.</p>
