Syllabus

<p>1— An action for damages to real estate is maintainable only by the person who owned or possessed the property at the time the damages were inflicted; a person who subsequently acquired it can not maintain the action.</p> <p>2— In a suit for damages against a railway company for taking private land for their road bed, the pleadings should identify the land taken by metes and bounds; and a judgment for the plaintiff should, after awarding him his damages, vest possession of the land in the company.</p>
