<p>Will — Probate—Undue influence — Evidence.</p> <p>On an issue devisavit vel non where it appears that the testatrix, an elderly widow, without near relatives, of perfectly sound mind, and with full knowledge of what she was doing, made her will, giving the bulk of her estate to her pastor and his family, binding instructions in favor of the will are proper, where the evidence shows that during the closing years of the testatrix’s life, she lived in great intimacy with her pastor, his wife and family, that she received kindnesses from them, gave them presents, and settled a portion of her estate during her lifetime upon her pastor, and there is no evidence whatever of any influence or persuasion exercised upon her by the beneficiaries either before the making of her will, or at the time thereof.</p>
