Syllabus
<p>Mortgages—Maturity—Default in Interest—Construction of Contract. A mortgage matures and may be foreclosed for the whole sum, upon default in the payment of annual interest, where the mortgage note provided for interest payable annually “and if not so paid to become a part of the principal and bear interest until so paid,” and the mortgage provided for its foreclosure in case of any default in the payment of interest when the same becomes due under the terms of the note, and further stipulated that in case of foreclosure, “the whole of said principal and interest, whether the same shall be then due or not” shall be retained.</p>
