Syllabus

<p>Where neither of the parties to a controversy about the title to a tract of land, has obtained the legal title thereto, but their titles are both purely equitable, and emanate from the same source, and each party is equally innocent, and each has been equally diligent, he who has the elder equity, must receive the legal title.</p>
