Syllabus

<p>1. In an action brought by husband and wife, in right of the wife, and to recover damages for injuries to her, the husband is not such a parly to the record as will .entitle the defendant to call him as for cross-examination, or to prove his declarations against his wife’s interest.</p> <p>2. If, 'in consequence of the negligence of a township to keep and maintain a public highway in a reasonably safe condition, an injury has been sustained by the plaintiff, it is no defence that the injury was caused by the combined effect of the negligence of the township and a negligent act of a third person.</p>
