<p>SYLLABUS BY THE COURT.</p> <p>Waters and Watercourses — Surface-waters. An action for damages cannot be maintained in this state against one who embanks against surface-waters to protect his own property, thereby causing such waters to remain on, or flow over, the lands of another, to his damage.</p>
