Syllabus

<p>Punitory or vindictive damages are not recoverable on the dissolution of an injunction, unless the evidence proves that the injunction was sued out maliciously and without probable cause; and in the absence of such proof, the defendants are entitled to no more than simple compensation for the actual loss sustained by them in consequence of the injunction, not to include attorney’s fees and costs incurred in their defense to the suit.</p>
