Syllabus

In this estate matter, we conclude Respondent is not the surviving spouse of the decedent, James Brown. Consequently, we reverse the decision of the court of appeals and remand the matter to the circuit court for further proceedings. Upon remand, the circuit court shall promptly proceed with the probate of Brown's estate in accordance with his estate plan.
