Syllabus

<p>Note of Married Woman.—A married woman is not bound by a promissory note executed by her jointly with her husband. It is the note of her husband alone.</p> <p>Complaint on Promissory Note. — A complaint in an action commenced after the death of the husband on a note and mortgage executed by the husband and wife during the life of the husband, does not state a cause of action, unless it aver that the husband in his lifetime failed to pay the note.</p> <p>Enforcement of Mortgage.—A mortgage given by the husband and wife during the life of the husband may bo enforced in an action against the heirs after the husband's death.</p>
