Syllabus
<p>No appeal lies from an order, made before final judgment, refusing to transfer a cause from a District Court of this State to the United States Circuit Court for trial, because the defendant is an alien.</p> <p>Hopper t. Kalkman (17 Cal. 517) affirmed.</p> <p>As no appeal lies from such order, the Supreme Court has no jurisdiction, on such appeal, to pass upon the merits of the motion to transfer the cause, even with the consent of the parties.</p>
