Syllabus
<p>Master and servant — Compensation out of profits — Contract.</p> <p>Where a person employed by a partnership is entitled under his contract to a weekly salary and also percentage of the profits “after the books of the business are closed for the year” he is entitled to receive his percentage immediately after the books have been closed for the year showing a profit after possible losses have been charged off; and the employers have no right to carry such profits to a suspense account and hold them until it should be determined whether certain outstanding open accounts could be collected.</p>
