Syllabus

<p>Railroads — Negligence—Sparks—Burning of buildings.</p> <p>In an action against a railroad company to recover damages for the burning of a barn, fences and other property by a fire alleged to have originated from sparks from a locomotive, the case is for the jury and a verdict and judgment for plaintiff will be sustained, where the evidence tends to show that the defendant permitted dry grass and other combustible matters to accumulate and remain on its right of way, that the fire started on the right of way after the passing of a particular locomotive, and that no person was noticed near the locality before the engine passed, or afterwards, until the fire was discovered.</p>
