Syllabus

<p>1. Under the provisions of § 66, act of March 81, 1860, P. L. 400, a borough ordinance contracting with a water company for a supply of water to the borough, enacted when a majority of the councilmen wez-e stockholders in the water company, is illegal and void and no liability can be enforced thereon.</p> <p>2. Nor will the fact that, for several years afterward the borough used and paid for water supplied under the contract, and that in some of those years, when the bills were passed, less than a majority, or none at all, of the councilmen were stockholders of the water company, constitute a ratification of such contract.</p>
