Syllabus

<p>Trial of Title in Action for Partition.—It is competent to try title in an action for partition of lands. (Be XJprey v. Be XTprey, 27 Cal. 329; and Morenkout v. Higuera, 32 Cal. 289, affirmed.)</p> <p>Admissions of Grantor.—Where the grantor of plaintiff, whilé occupying the granted premises, made admissions against the title under which plaintiff claims, held admissible in evidence against plaintiff on the trial of an issue of title.</p>
