Cummings, 7 Akiz. 258, 64 Pac. 443, Follow. —A materialman furnishing supplies- to an assignee in poeooaoior’ and working a mine under a contract of purchase is entitled to a lien only as against the estate of the assignee therein although the owner has knowledge and acquiesced in the work for which the supplies were furnished.</p>
