Syllabus

<p>INTERVENTION-GROUNDS OE-ISSUE AEEECTING LAND IN OTHER COUNTY.</p> <p>In an action to compel the issuance to plaintiff of stock.in a mining company, wherein a complaint in intervention claiming an interest in a portion of the same stock is filed, the intervenor cannot ask for the rescission of a contract of conveyance of land in another county because of the fraud of one of the defendants in procuring a transfer of such stock in consideration of said conveyance.</p> <p>APPEAL-STRIKING ALLEGATIONS OE ANSWER- CURED BY ADMISSION OE EVIDENCE.</p> <p>Error of the court in striking a portion of the answer of defendants in not prejudicial when testimony in support of the stricken matter is subsequently admitted.</p> <p>SAME-SUEPICIENCX OE EVIDENCE.</p> <p>Where there is a substantial conflict in the testimony, the findings of the trial court will not he disturbed on appeal.</p>
