Syllabus
<p>1. Private Roads. Establishment.,. Effect.</p> <p>Since section 170 of the Constitution of 1890 gives the board of supervisors jurisdiction over the opening of private roads,' where an order of the board opening a private road over the lands of the owner showed that he appeared in the proceedings, such order is not invalid, although the owner’s covenant to give the person for whose benefit the road was opened a right of way over his land was void.</p> <p>2. Private Roads. Establishment. Irregularity.</p> <p>The only way in which a landowner over whose lands a private road is located by the board of supervisors can question the order on account of irregularity is by direct appeal.</p>
