Syllabus

<p>A town site patent issued by the land office officials cannot be collaterally attacked by private parties locating mining claims subsequent to the entry of the town site and issuance of the patent, on the theory that the land covered by the patent was known to be mineral at the time of its entry, and hence did not pass by the patent under Rev. St. U. S. 2392 [U. S. Comp. St. 1901, p. 1459], providing that no title shall be acquired under the town site law to any mine or valid mining claim.</p>
