Syllabus
<p>SYLLABUS BY THE COURT.</p> <p>1. Highways — Establishment—County Commissioners. Under section 6044 of the General Statutes of 1901 a road may be legally established by the board of county commissioners, if the proceedings prescribed by law for the establishment of public highways generally are followed, and such road is established as a public highway.</p> <p>2. -Petition — “Private Road” — Immaterial Description. The mere fact that the word “private” is used in the petition and other papers and proceedings relating to the establishment of a road under the above-mentioned statute, as a part of the description thereof, will not affect the validity of a road so established.</p>
