Syllabus

<p>1. Navigable Watbbs — Title to Bed — Sale by State. ,</p> <p>The right of the state to sell the bed of á stream which has ceased to be navigable cannot be disputed. The title to the bed of a navigable stream is in the state, subject to the-paramount right of navigation in the public.</p> <p>[Ed. Note. — For eases in point, see Cent. Dig. vol. 37, Navigable Waters, §§ 180-200.]</p> <p>2. Same.</p> <p>Held, on the facts of the case, that the evidence failed to show that the stream surveyed and sold as a portion of a section of land was navigable at the date of the conveyance, and, further, that, even were it otherwise, the title of the state was good, and the purchaser cannot complain until disturbed by some exercise of the right of navigation in the public.</p> <p>3. Vendor and Purchaser — Objections by Vendee — Location oe Tract.</p> <p>A purchaser given 30 days to make a survey before accepting title cannot complain of error as to the location or character of the tract of land conveyed by sectional subdivisions.</p> <p>(Syllabus by the Court.)</p>
