Syllabus

<p>Boroughs — Contract—Lease of pleasure park.</p> <p>A borough has no power to enter into a contract to lease from a private owner an enclosed pleasure park within the borough limits, for the purpose of deriving a revenue therefrom by subletting or charging the public for admission; and if, in pursuance of such an agreement, the borough enters into possession of the park no recovery can be had from the borough as for the use and occupation of the same.</p>
