<p>Syllabus.</p> <p>1. Where a detailed account showing a balance due has been rendered and received, and the debtor does not within a reasonable time challenge its correctness, but on the contrary promises 'to pay and simply requests the indulgence of time, it thereby becomes an account stated, the equivalent of an acknowledgment and settlement between the parties.</p> <p>2. An objection that an account contains usurious charges comes too late when made for the first time more than a year after the account has attained the dignity of an account stated.</p>
