<p>'Syllabus.</p> <p>1. while the right of appeal is given to third parties not parties to the suit, they, as a condition to sustain their appeal, must allege and show wherein they are aggrieved by the judgment.</p> <p>2. In matter personal to the defendant, wherever it does not appear that appellant can have a grievance of any kind to complain of, in so far as he is personally concerned, he cannot be heard to set aside the proceedings.</p>
