11/14/2024 The circuit court did not abuse its discretion when it admitted a child's out-of-court statements describing acts of sexual abuse into evidence pursuant to Code § 19.2-268.3. In addition, the defendant had a sufficient opportunity to confront and cross-examine the child who made the statements when she testified at the preliminary hearing. Accordingly, the judgment of the Court of Appeals upholding the conviction is affirmed.
