Syllabus

<p>Appeal. Attachment for rent. Amoimt in controversy. Code 1893, § 85.</p> <p>Upon an appeal to the supreme court from a judgment of the circuit court, in favor of a landlord, in an action of replevin by the tenant for property distrained for rent, begun in a justice’s court, the amount in controversy is determined by the rent due, as adjudged by the circuit court, and not by the value of the property seized.</p>
