<p>Syllabus.</p> <p>On Motion to Dismiss Appeal.</p> <p>1. The right to subsequently appeal is not barred by the failure to prosecute a prior order of appeal provided no bond was furnished pursuant to said order.</p> <p>2. Those only are necessary parties appellee who have an interest in maintaining the judgment.</p> <p>3. On the merits, questions of fact only are involved.</p>
