Syllabus

<p>Compensation for services rendered by a wife — Outside of home of her husband — Is recoverable in her own name, when— Consent of husband, to such services, not necessary, when.</p> <p>1. Compensation for services rendered by a wife outside of the home of her husband, with whom she is living, such services not being in the discharge of her household or domestic duties and not in interference therewith, is recoverable in an action therefor in her own name and for her own use.</p> <p>2. In such an action by the wife, it is not necessary, in order that she recover, that it be shown that the services were rendered' with the consent of her husband and that there was an understanding between them that the same should be on her own account and that she should receive the compensation therefor.</p>
