Syllabus
<p>1. Adoption of Infants. Code of 1880, g 1496. Code 1892, g 492.</p> <p>Under code of 1880, § 1496, providing for the adoption of infants, if the child of another be adopted, such child does not become the heir of petitioner, unless heirship be one of the gifts, grants, or benefits proposed to be conferred upon the infant.</p> <p>2. Same. Consideration. Res adjudicate.</p> <p>In such case, the effect of a final judgment of adoption cannot be avoided for want of consideration. The decree itself precludes such inquiry.</p> <p>3. Same. Specific enforcement of right. Uncertainty.</p> <p>If the adoption proceedings provide, among other things, that the child shall receive, at petitioner’s death, all property of petitioner not devised to others, the adopted eh’ld cannot claim anything, by way of specific enforcement of the decree, because of uncertainty as to the property.</p>
