Judgment reversed where res judicata did not bar non-party's, third-party claim to funds deemed forfeited in criminal proceeding by consent of defendants who disclaimed ownership, and state failed to follow forfeiture procedure under R.C. Chapter 2981 after trial court entered sua sponte dismissal of the civil forfeiture case, prior to adjudication.
