Syllabus
<p>1. In an application to this court under section 5085, Comp. Haws, to settle a bill of exceptions, on the ground that the trial judge refuses to settle the same in accordance with the facts, every presumption is in favor of the correctness of the bill as settled by the trial judge, and it will stand, unless the attacking party affirmatively shows its incorrectness.</p> <p>2. In this case affidavits and statements examined, and certain amendments to bill directed.</p> <p>(Syllabus by the .Court.</p>
