Syllabus

<p>In an action to recover statutory amounts for the' failure of tbe carrier to properly equip tbe cars used for hauling lumber and timber, it is error to exclude testimony that tbe ears were under a special contract allowed to go out on a private track to be loaded beyond tbe control of tbe carrier, where the real shipper bad contracted to properly equip tbe cars before loading them to be transferred to the carrier on its line.</p>
