<p>SYLLABUS BY THE COURT.</p> <p>Railroads — Bightof Way — Bightto Condemnation Money. The fact that a railroad company has conducted land-condemnation proceedings to completion, and has deposited the condemnation money with the county treasurer, does not preclude it from reclaiming the deposit, if it has abstained from making an actual entry on the land for the purpose of constructing its road, and has abandoned its intention to use the land for such purpose, and has given notification of such abandonment.</p>
