Syllabus
<p>SYLLABUS.</p> <p>1. The court can so iar • inquire into a judgment, rendered against a county, as to ascertain if the claim is legally payable out of taxes sought to be so applied.</p> <p>2. A claim against a county merged into judgment, carries with it all the infirmities of want of authority of the county commissioners to levy a tax to pay such claim.</p> <p>3. If the county commissioners have no authority to levy a tax to pay a claim against a county, they have no authority to levy a tax to pay a judgment based on such claim.</p>
