Syllabus

<p>Judgment: husband and -wife. A judgment which erroneously includes the wife with the husband, while void as to the former, is valid as to the latter, except when attacked on appeal or in a direct proceeding' to vacate it; and it is a bar to a recovery in a second suit upon the same cause of action.</p>
