Syllabus

<p>1. The estate of a decedent in Pennsylvania is cast upon the heirs at law directly the ancestor dies, subject, however, to the jurisdiction of the Orphans’ Court to administer the same, both real and personal, first of all for the benefit of creditors and next for legatees, devisees and heirs.</p> <p>2. Where a decedent in his lifetime held a policy of fire insurance upon real estate which was destroyed by fire, after his death but while the policy was in force, the insurance payable thereon is an asset of the estate with which the administrator is chargeable, and the right of the heirs thereto is subordinate to that of the creditors.</p>
