Syllabus

<p>1. On account of the identity of interest of husband and wife, where one of them is incompetent to testify as a witness, the other also is incompetent : Bitner v. Boone, ante, p. 567.</p> <p>2. Specific performance of a contract to convey land will not be decreed, where the terms of the contract ai'e not shown, delay in instituting the proceeding is unexplained, and the whole matter rests upon inference.</p>
