Syllabus
The trial court did not err in finding the appellant in civil contempt where he admittedly did not make child support payments as ordered. The fact that the appellant was not found to be underemployed does not mean that he established an inability to pay child support as ordered. The appellant's challenge to his thirty-day jail sentence for failing to purge the contempt is moot because the trial court released him from jail after one day and re-imposed purge conditions. The remaining twenty-nine days will not be imposed unless or until the appellant fails to comply with the purge conditions, which are matters for an appeal after a purge hearing and execution of the remaining sentence. Judgment affirmed.
