Syllabus

<p>1. Principal and Agent. Dealer agent of owner of xautom-obiles shipping to dealer reserving title.</p> <p>Where the owner of automobiles ships car to a selling dealer and reserves title in himself, the selling dealer is the agent of the owner, in so far as the public is concerned.</p> <p>2. Principal and Agent. Selling agent, representing secondhand car to be new, acts within scope of authority.</p> <p>When the selling agent represents that a secondhand car sold is a new car, he is acting within the scope of his authority, where innocent purchasers are concerned, and such purchasers may sue the owner for breach oí warranty.</p>
