Anderson v. Reel Hospitality, LLC

Syllabus

The plaintiffs, who had been employed as servers at a restaurant owned and operated by the defendants, appealed from the trial court's judgment granting in part the defendants' motion for summary judgment on the count of their complaint alleging violations of the applicable wage regulation (§ 31- 62-E3). They claimed that the court improperly determined that a violation of the recordkeeping requirements in § 31-62-E3 of the regulations did not, by law, give rise to a private right of action. Held: The trial court properly granted in part the defendants' motion for summary judgment, as this court's conclusion in Nettleton v. C & L Diners, LLC (219 Conn. App. 648) that the requirements set forth in § 31-62-E3 of the regulations are directory and do not give rise to a private cause of action was dispositive of the plaintiffs' appeal.
