Syllabus

The defendant, Nicholas Tsonos, appealed from an order entered in Family Court denying his motions to modify visitation with and placement of his three sons and ordering him to submit to a mental health evaluation pursuant to Rule 35(a) of the Family Court Rules of Domestic Relations Procedure. On appeal, the defendant argued that the trial justice abused his discretion because the trial justice's findings were not adequately supported by the record, were not tied to empirical evidence, were contradicted by the record, or were ambiguous. The Supreme Court held that the trial justice did not abuse his discretion because there was substantial evidence in the record to support his findings. Thus, the Supreme Court affirmed the order of the Family Court.
