Settlement agreement enforcement trust trustee beneficiary R.C. 5808.02(A) contrary public policy fiduciary contract misconstruction reversed remanded. The settlement agreement required the Trustee to transfer trust assets in a manner that did not serve the best interests of the trust beneficiary. Enforcement of the settlement agreement would bring about a result the General Assembly sought to prevent by enacting R.C. 5808.02(A). The trial court erred by granting Alotech's motion to enforce the settlement agreement.
