Syllabus

<p>1. Payment op Jury Fee.—The failure to pay the jury fee on the first day of the term does not forfeit the right to a jury when such failure does not operate to the prejudice of the opposite party.</p> <p>2. Same.—A party demanded a jury on the first day of the term, paid the fee on second day, the case was called on the third day of the term, the jury cases on the civil docket were set for the second week of the term, Held, error to disregard the demand for a jury and proceed to try the cause.</p>
